Terms of Use

Welcome to Art Loves Children. These Terms of Use ("Terms") govern your access to and use of artloveschildren.org (the "Site") and any related services. By using the Site, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or create an account.

2. Accounts

You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. You agree to notify us promptly of any unauthorized use.

3. Commissions and Orders

• Commissions require a non-refundable 20% deposit at the time of order. The remaining balance is due before the artwork ships.
• Each piece is hand-painted and one-of-a-kind. Slight variations from reference photos and digital previews are part of the medium and not defects.
• Turnaround times are estimates and may vary based on the artist and shipping route.
• Orders may be canceled before painting begins for a refund of the deposit minus a reasonable processing fee. Once painting begins, the deposit is non-refundable.

4. Reference Photos and User Content

By uploading photos or other content, you represent that you own or have permission to use them. You grant Art Loves Children a non-exclusive, worldwide, royalty-free license to use that content solely to fulfill your commission and, with your consent, to showcase the finished artwork in our gallery and marketing.

5. Intellectual Property

The Site, its content, and trademarks are owned by Art Loves Children or its licensors. You may not copy, modify, distribute, or create derivative works without our written permission. The physical artwork you commission is yours; the artist retains copyright in the underlying image unless explicitly assigned in writing.

6. Payments

Payments are processed by third-party providers (e.g. Stripe). You agree to their terms when paying. Prices and availability may change without notice.

7. Shipping and Risk of Loss

Title and risk of loss pass to you when the carrier accepts the package. We are not responsible for carrier delays, but we will help resolve issues where possible.

8. Returns

Because each piece is custom and hand-painted, all sales are final unless the artwork arrives materially damaged or differs significantly from the approved sketch. Contact us within 7 days of delivery to report an issue.

9. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose
• Upload content that is infringing, defamatory, obscene, or harmful
• Interfere with the Site, attempt to access it without authorization, or scrape it
• Use the Site to harass, abuse, or harm another person

10. Disclaimers

The Site and services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Art Loves Children and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Site or a commission will not exceed the amount you paid for the commission at issue.

12. Indemnification

You agree to indemnify and hold Art Loves Children harmless from claims arising out of your use of the Site, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Art Loves Children is established, without regard to conflict of laws principles. Disputes will be resolved in the courts of that jurisdiction unless otherwise required by law.

15. Changes

We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
